Have you ever wondered if聽you could turn your scrumptious homemade baked goods or聽Christmas
Unlike selling other products from your house, selling food comes with unique obstacles and聽hurdles you have to聽overcome. Scared? Don鈥檛 be! We鈥檙e here to聽help.
License and聽Permit Requirements
Before you start selling food from your home kitchen, you may be聽required to聽obtain a聽business license and聽a聽food handler鈥檚 permit. A聽business license is聽not always necessary to聽start your business (this all depends on聽your state鈥檚 laws).
Many states and聽municipalities require you to聽obtain a聽general business license to聽operate your business, which simply requires you to聽fill out general information, such as聽the聽business address and聽contact information. Make sure you keep track of聽your sales even if聽you do聽not need a聽business license in聽your state because all states require you to聽pay taxes. If聽you plan to聽take your sales online, you do聽not need to聽worry about getting a聽business license in聽every state, you just need a聽business license from the聽state you are operating in.
You will also need to聽get a聽food handlers鈥 permit from your state. Normally you will be聽required to聽pay a聽small fee and聽take a聽short course in聽order to聽do聽this. You will then have to聽recertify your education every couple of聽years by聽either retaking an聽updated version of聽the聽course or聽a聽supplemental course.
Here are some examples of聽a聽few states and聽their business license requirements:
- you to聽register your business name if聽you plan to聽do聽business under another name other than your legal name. You will need to聽register for聽taxes with the聽Tax Department as聽well. Like many states you will need to聽check with your local authorities depending on聽which city and聽county you live in聽to聽make sure you are following local authorities laws as聽well.
- does not require you to聽register a聽Doing Business As聽(鈥淒BA鈥) name. However, they do聽have many local municipalities that regulate the聽licenses and聽permits that you need. Like virtually all states you will need to聽register your business with the聽tax department.
- has been recognized as聽one of聽the聽best states to聽start a聽business in, as聽the聽barrier for聽entry is聽very low. You don鈥檛 have to聽have a聽general business license in聽Texas to聽start your operations.
- requires you to聽file for聽a聽DBA name and聽get a聽resale permit. California also requires that you run a聽
4-week announcement of聽your DBA name in聽your local newspaper. You will still need to聽check your local laws as聽well because the聽licenses required could change depending on聽which city and聽county you live in.
Cottage Food Laws
Cottage food laws aren鈥檛 just for聽people selling food in聽cottages (unfortunately!). Rather, they apply to聽individuals who want to聽make an聽income selling food from their home kitchen.
So, before selling any聽products that come from your home kitchen you will need to聽do聽some research. Cottage food laws vary from state to聽state so聽make sure you look up聽your local laws. Cottage food laws are normally enforced by聽your local health department or聽state department of聽agriculture, either of聽these state department websites will usually be聽the聽extent of聽research you need to聽do.
Generally, cottage food laws require that you obtain a聽business license, a聽
Cottage food laws limit the聽kinds of聽foods that you can sell. You will most likely be聽limited to聽foods that will not produce
If聽the聽products you make are outside the聽scope of聽the聽cottage food laws, don鈥檛 worry! You can still sell them, you will just have to聽meet some additional requirements. You may have to聽cook your foods in聽a聽commercial kitchen (note that you can usually rent out a聽space that would meet the聽commercial kitchen standards determined by聽your local health department). You may also have to聽meet additional health inspection requirements and聽need additional licensing to聽make sure you are complying with commercial food manufacturing laws.
Some state cottage food laws also limit the聽income you can make by聽selling food from your home. Once you reach a聽certain income level you may be聽required to聽comply with commercial food manufacturing laws.
Take Your Sales Online
Once you get all your licensing requirements and聽other legal requirements taken care of聽you can start expanding your business online. If聽you decide to聽use an聽online marketplace, you need to聽make sure to聽comply with their terms and聽conditions.
Selling homemade food products on聽Etsy, for聽example, is聽pretty easy. They do聽not require any聽additional requirements other than to聽make sure you are following local laws and聽regulations. Etsy does recommend checking with the聽shipping company to聽make sure that the聽goods you plan on聽shipping are allowed by聽the聽company. Some shipping companies may not accept certain goods for聽various reasons, so聽it聽is聽important to聽make sure whether you choose UPS, USPS, or聽FEDEX your goods will be聽accepted and聽shipped.
If聽you are thinking about selling food through Amazon, you鈥檒l need to聽make sure to聽follow a聽couple of聽additional guidelines. Similar to聽Etsy, Amazon requires that you are in聽compliance with local laws, and聽have all federal and聽state required licenses and聽permits. Amazon has a聽couple of聽additional labeling requirements, mainly in聽regards to聽expiration dates.
For example, if聽you sell foods that will go聽bad, you must make sure that when they are delivered your products will have an聽additional shelf life after they arrive to聽your customer. If聽you sell a聽multipack of聽your product, then the聽expiration dates must match on聽all the聽units. You will want to聽make sure you follow Amazon鈥檚 policies correctly. Failure to聽do聽so聽can result in聽you being barred from selling your food products on聽Amazon鈥檚 website.
You can also make your own website to聽sell through, with the聽help of聽an聽ecommerce platform such as聽. If聽you decide to聽go聽this route you will need to聽make sure you are following all your local laws and聽are properly shipping your products. But we聽highly recommend looking into an聽ecommerce solution to聽give you the聽most freedom in聽selling your products, promoting them, and聽saving money on聽shipping labels.
